Heard learned counsel for the applicants, learned A.G.A and gone through the record.
This bail application has been moved on behalf of accused- applicants 1. Anand Shukla and 2. Madhuri Shukla, who are involved in case crime no. 187 of 2015 under Section 147, 148, 323, 504, 506, 452, 308, 304 I.P.C., Police Station- Paikoliya, District-Basti.
Submission of learned counsel for the applicants is that in the similar set of facts, in respect to the same occurrence co- accused Nidhi Shukla and Neelam Shukla have been provided bail by co-ordinate Bench of this Court on 24.11.2017 and 29.11.2017 in Crl. Misc. Bail Application No.45541of 2017 and Crl. Misc. Bail Application No.46669 of 2017 respectively, claiming parity, pleading false implication it is lastly contended that the accused applicants are languishing in jail since 06.06.2019.
Learned A.G.A has opposed the prayer for bail. However granting bail to co-accused persons and parity has not been disputed.
Keeping in view the nature of offence, evidence, complicity of the accused, severity of punishment, submissions of the learned counsel for the parties and without touching the merits of the case in my opinion the accused applicants are entitled for bail.
Let the above named applicants involved in the aforesaid crime be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions:-
1. The applicants shall not tamper with the prosecution evidence, shall cooperate in investigation or trial and shall not indulge in any criminal activity or commission of any crime after being released on bail.
2. In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicants and sureties be verified by the court concerned before the bonds are accepted.
