The instant application under section 482 Cr.P.C. has been filed for issuing direction to ACMM Court No.2 Kanpur Nagar to decide the Complaint Case No.1156 of 2015 (Smt. Anita Saini Vs. Sunil Kumar Gupta and others) under sections 323, 504, 354, 452, 392, 506 IPC, P.S. Kalyanpur, District Kanpur Nagar, pending in the court of A.C.M.M., Court No.2, Kanpur Nagar, expeditiously.
Learned counsel for the applicant submits that the applicant has filed application under section 156(3) Cr.P.C. before the court of A.C.M.M. Court No.2, Kanpur Nagar for registering the FIR against the opposite party nos. 2 to 5. Vide order dated 11.03.2015 passed by the court concerned, the case was registered as Complaint Case No.1156 of 2015 (Smt. Anita Saini Vs. Sunil Kumar Gupta and others). Thereafter vide order dated 27.07.2016 the opposite party nos. 2 to 5 have been summoned under sections 323, 504, 354, 453, 392, 506 IPC to face trial and since then the case pending before the court concerned.
Learned A.G.A. opposed the contentions raised on behalf of the applicant.
In view of the facts and circumstances, the A.C.M.M. Court No. 2, Kanpur Nagar is directed to decide Complaint Case No.1156 of 2015 (Smt. Anita Saini Vs. Sunil Kumar Gupta and others) under sections 323, 504, 354, 452, 392, 506 IPC, P.S. Kalyanpur, District Kanpur Nagar, pending in the court of A.C.M.M., Court No.2, Kanpur Nagar, expeditiously, preferably within a period of six months from the date a certified copy of this order is produced before it.
The application u/s 482 Cr.P.C. is disposed of accordingly.
