Heard learned counsel for the petitioner and Shri Anurag Srivastava, learned Standing Counsel.
The petitioner is permitted to implead State respondent as party respondent to the writ petition and serve a copy of the writ petition to learned Standing Counsel forthwith.
In view of the order proposed to be passed, notices need not go to private respondents.
The petitioner is before this Court for a direction to the Tehsildar (Judicial), Sadar, Varanasi to decide Mutation Application Case No.908 of 2017 Computerized Case No.T 201714703001908 filed under Section 34/35 U.P. Revenue Code, 2006 within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of finally with a direction to the Tehsildar (Judicial), Sadar, Varanasi to consider and decide the aforesaid case in accordance with law expeditiously and preferably within a period of six months from the date of production of certified copy of this order but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, except upon payment of cost.
