JUDGMENT / ORDER

Parcha filed by Sri Sitla Pandey on behalf of complainant is taken on record.
Heard learned counsel for the applicant, learned counsel for the complainant and learned A.G.A. for the State and perused the record.
Learned counsel for the applicant contended that F.I.R. was lodged on the basis of suspicion. Subsequently when prosecutrix was recovered her statement was recorded. From perusal her statement it appears that she was consenting party. According to medical report she was aged about 18 years. There was no external or internal injury. No offence is made out against the applicant. Applicant is in jail since 20.4.2010.
The bail is opposed by learned counsel for the complainant and learned A.G.A. on the ground that there is allegation of rape against the applicant.
Considering the aforesaid facts, without observation on merit it is a fit case for bail. Let the applicant namely, Anand Mohan @ Vittu be released on bail in Case Crime No. 510 of 2010, under Section 363, 366, 376 I.P.C., Police Station Kotwali Khalilabad, District Sant Kabir Nagar on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
