Petitioner is before this Court with a request to direct the learned Civil Judge (Sr. Div.) Court No. 3, Etawah not to proceed in Civil Suit No. 271 of 2002 (Balveer Singh Vs. Ashok Kumar and others) till the disposal of Civil Misc. Writ Petition No. 37196 of 2011 (Anita Kumari Vs. Balveer Singh and others) which is pending before this Hon'ble Court.
Learned counsel for the petitioner submits that the aforementioned writ petition is pending consideration, however, during pendency of the same such a situation arose that the petitioner once again has appeared before this Court.
In this backdrop, once the Court has declined to interfere in the matter under Article 227 of the Constitution of India, learned counsel for the petitioner very fairly states that leave may be accorded to the petitioner to agitate her rights in the pending writ petition.
The writ petition is dismissed as not pressed. However, dismissal of the writ petition would not come in the way of the petitioner to agitate her rights in the pending writ petition as well as in the suit.
