Heard learned counsel for petitioner and learned Standing Counsel for the State-respondents.
This writ petition has been filed seeking the following among other relief:-
"i. issue a writ order or direction in the nature of mandamus commanding the respondent no. 2 to decide the Case no. T-201817650301945 (Anand Kumar Srivastava & Others Vs. Ishwar Saran Lal & Others), under section 229B/144, 209, 176 U.P.Z.A. Act pending before the Court of Sub-Divisional Magistrate, Tehsil Mehendawal, District Sant Kabir nagar within a stipulated period."
It is stated by the counsel for the petitioner that a suit for declaration, partition and possession under Sections 229B/144, 209, 176 U.P. Zamindari Abolition & Land Reforms Act is pending consideration since the year 2009 at the state of evidence.
In view of the above, without entering into the merits of the controversy between the parties, I dispose of the writ petition with a direction to the respondent no. 2, Sub Divisional Magistrate (in short 'SDM'), Mehendawal, District Sant Kabir Nagar to consider and decide the suit under Sections 229B/144, 209, 176 U.P. Zamindari Abolition & Land Reforms Act expeditiously, preferably within a period of three months from the date of production of a certified copy of this order before him.
