Heard the counsel for the parties.
The present writ petition has been filed praying for a writ of mandamus commanding the respondent authorities to consider the claim of the petitioner for promotion to the post of Senior Clerk.
It has been stated in paragraph No. 5 of the writ petition that the petitioner was named in Crime No. 238 of 2011, under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code.
There is no averment in the writ petition that the petitioner has been acquitted of the charges.
In view of the aforesaid, it is not a fit case for grant of mandamus as prayed by the petitioner in exercise of the extraordinary jurisdiction under Article 226 of the Constitution of India.
The writ petition is dismissed.
