The present revision arises out of judgment and order dated 4.12.2010 passed by the Special Judge (CBI) (Ayodhya Prakaran), Lucknow in Regular Civil Appeal No.111 of 2008. Therefore, the present revision is not maintainable in view of Full Bench judgment in the case of M/s Jupiter Chit Fund (Pvt.) Ltd. Vs. Dwarka Diesh Dayal and Others reported in AIR 1979 Allahabad 218. The same was thereafter followed in Full Bench of Ganga Saran Vs. Civil Judge, Hapur reported in (1991) 17 ALR 380.
In view of aforesaid two full Bench decisions, present revision is not maintainable and the same is dismissed. Lower Court record if summoned, be returned forthwith.
