The petitioner's contention is that he was a bhumidhar over Plot No.1671 and submits that even though various litigations were going on with regard to Plot No.1671 viz. consolidation proceedings which have been stayed by the High Court and the Suit against the Gram Pradhan which was filed by him and was numbered as 381 of 2008, the possession, as of today, over the Plot No.1671 was his. The grievance of the petitioner is that he was not being allowed to cut the Peepal tree which was standing on Plot No.1671 and had been uprooted. In this regard he has moved an application before the Sub-Divisional Magistrate, Tehsil Tamkuhiraj, District Kushinagar.
The Sub-Divisional Magistrate may look into the representation of the petitioner and pass a reasoned order in accordance with law within a period of two weeks from the date of presentation of a certified copy of this order, if there is no other legal impediment.
The writ petition is, accordingly, disposed of.
