***** THIS CCC COMING ON FOR HEARING BEFORE FRAMING OF CHARGES THIS DAY, RAVI MALIMATH J., PASSED THE FOLLOWING:
ORDER This petition is filed on the ground that the order dated 08.01.2019 passed in Writ Petition No.34969 of 2018 and Writ Petition No.37021 of 2018 by the learned Single Judge, has been disobeyed.
2. In terms of the said order, a mandamus was issued to respondent No.4 therein to consider the representation of the petitioner within a period of three months. Since the same has not been done, the instant petition is filed.
3. An affidavit is filed by the accused in the Court today. He has tendered an unconditional apology for the delay in complying with the order of the learned Single Judge within the timeframe. He has also produced Annexure-R1, which indicates compliance of the order of the learned Single Judge.
4. For the reasons assigned, the apology is accepted and the delay in complying with the order of the learned Single Judge is condoned.
5. In view of the consideration of the representation of the petitioner in terms of Annexure-R1, we do not find any grounds to proceed further. Hence, the proceedings are dropped.
