Anand Kumar (Dewar) And Others vs State Of U.P.Through Secretary ...

High Court Of Judicature at Allahabad|25 June, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioners and the learned Government Advocate as well as Sri Mayank Pande, appearing on behalf of respondent no. 3, who has filed counter affidavit, which is taken on record.
By means of this writ petition, the petitioners have prayed for issuance of a writ in the nature of Certiorari for quashing the FIR registered as Case Crime No.03/2010 under Sections 498A/323 I.P.C. and 3/4 of Dowry Prohibition Act, Police Station Mahila Thana, District Ambedkar Nagar.
We have gone through the contents of the FIR as well as injury report of the victim. We do not see any justifiable reason to quash the FIR which discloses commission of cognizable offence.
Petition is misconceived and is according dismissed.
However, seeing that it is a matrimonial dispute, it is provided that if the petitioners surrender and move application for bail, the same shall be considered and disposed of expeditiously by the courts below.
