JUDGMENT / ORDER

On an oral request made by learned counsel for the petitioners, to which there is no objection, he is permitted to implead the Executive Director of the Council as opposite party no.5 during course of the day.
Heard.
Submission of learned counsel for the petitioners is that the petitioners had taken admission in I.T.I. in the opposite party no.4 / Institution. The examinations are to be held from 01.03.2021 and the petitioners have already completed the formalities and deposited the examination fees with the opposite party no.4 but due to fault of the opposite party no.4, the same has not been uploaded on the SCVT portal which was to be uploaded from 12.02.2021 to 22.02.2021, therefore the petitioners' admit card have not been issued. Being aggrieved the petitioners made a representation to the opposite party no.1 but the same has not been considered whereas the examination of the petitioners is to be held on 02.03.2021 and the petitioners may suffer due to fault of the opposite party no.4. Therefore they may be permitted to appear in exam.
Submission of learned Standing Counsel is that the representation of the petitioners may be considered by the concerned authority in accordance with law within the time provided by this Court.
Considering the nature of order proposed to be passed, the issuance of notice to the opposite party no. 4 is dispensed with.
In view of above, without entering into the merit of the case, the writ petition is disposed of providing herein that the representation of the petitioners shall be considered by the concerned authority in accordance with law after affording opportunity or calling a report from the opposite party no.4 expeditiously say by 01.03.2021 and in case the petitioners have completed the formalities, the authorities may look that the petitioners may not suffer due to fault of the opposite party no.4, if there is no impediment.
The consequences shall follow accordingly as per law.
Liberty is granted to the petitioners to make a fresh representation to the competent authority alongwith certified copy of this order within 24 hours.
Learned Standing Counsel shall communicate this order to the concerned authority forthwith.
A certified copy of the order shall be given to the learned counsel for the parties on payment of usual charges today.
