Heard learned counsel for the petitioner; the learned A.G.A. for the respondents 1 and 2; and perused the record.
The instant petition seeks quashing of the first information report dated 31.01.2018 which has been registered as Case Crime No. 0056 of 2018 at P.S. Hata, District-Kushinagar, under Sections 419, 420, 467, 468, 471, 506 I.P.C.
The allegation in the first information report is of duping the informant under assurance of securing appointment. Various money transactions are disclosed in the first information report and the bank statement of the petitioner, which has been brought on record, also disclose receipt and transfer of money. There is no proper explanation in the writ petition as to in which connection the money was received and transferred.
Under the circumstances, it cannot be said that a prima facie case is not made out against the petitioner. Hence, the prayer to quash the first information report or to interfere in the investigation cannot be accepted.
The petition is dismissed.
