Heard learned counsel for the petitioners and learned Standing Counsel for the State respondents.
Petitioners claim themselves owner and 'bhumidhar' of khasra plot no. 79Ka situate in village Jalhupur, Tehsil Sadar, district Varanasi which is contiguous of plot no. 79Ga which is subject matter of acquisition by State authorities for establishing Fire Brigade Centre.
Grievance of the petitioners is that without demarcating the said two plots, in the name of acquisition, entire area of plot no. 79Ka belonging to the petitioner is being taken over in the garb of requisitioning of plot no. 79Ga.
In such circumstances, let the petitioners make an application before the District Magistrate, Varanasi for carrying out demarcation and measurement of the two plots namely, plot nos. 79Ka and 79Ga along with a certified copy of this order within fifteen days from today. In case any such application is made, the District Magistrate shall proceed to get the two plots demarcated on the spot and only thereafter the authority shall proceed to take possession over plot no. 79Ga after separating the area of the petitioners' plot no. 79Ka.
With the aforesaid observations and directions, writ petition stands disposed of.
