JUDGMENT / ORDER

Both learned counsel, Mr.U.D.Shukla for Mr.Manav A.Mehta, learned advocate for the appellant and learned Senior Advocate, Mr.Mihir Joshi for M/s Nanavati Associates appearing on caveat for the respondent No.1, which is the main contesting party, have made a joint statement at the bar that if injunction application is directed to be decided expeditiously, they would not invite for reasoned order.
In view of the above joint statement, without deciding the matter on merits, learned District Judge, Ahmedabad (Rural) is directed to dispose of injunction application [Ex.5) in Civil Suit No.10 of 2012 on or before 14th August, 2012 without fail on its own merits, in accordance with law and without being influenced by this order. Both the learned counsel for the parties have assured before this Court that their respective clients will extend full co-operation in disposal of the injunction application as aforesaid without seeking any unnecessary adjournment.
With the above direction and observation, this Appeal From Order and Civil Application stand disposed of. Direct service is permitted.
