JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Learned counsel fairly conceded that the petitioner was required to pursue appropriate alternative remedy provided under the Gujarat Panchayats Act, 1993. He, however, also submitted that the alleged misdeeds of the Election Officer, respondent No.4 herein need to be departmentally dealt with by his superior officer in the interest of preserving democratic institution and fairness of the elections. We are sure that if the petitioner has approached or approaches the superior officer concerned with necessary material in respect of serious allegations made by her, the authority concerned will take serious view of the matter and take appropriate action at their end. With these observations, the petition is disposed of as not pressed with a view to approaching the appropriate authority for adjudication of the election dispute in accordance with law.
