Mr. Amit V. Thakkar, learned counsel for respondent no.1 waives service of notice of rule.
[2] By way of this petition, the petitioner has challenged the order dated 03.03.2012, passed by the Gujarat State Co-operative Tribunal, Ahmedabad, in Misc. Application No. 270 of 2010, whereby the Misc. Application was rejected and the petitioner was not granted leave to defend the Suit.
[2] Taking into consideration that the amount directed to be deposited for granting leave to defend has been deposited by the petitioner as directed, but there was some delay in deposing the same, leave to defent ought to have been granted. The petition is allowed. However, as the suit is pending since the year 2003, the Board of Nominees is directed to dispose of the suit within one month from the receipt of the order.
