JUDGMENT / ORDER

Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Excise Station, Thandur, Ranga Reddy District, to release the petitioner on bail in the event of his arrest in connection with Crime No. 637 of 2013-04 of Thandur Excise Station, Ranga Reddy District, in the interest of justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri Abbagani Venkateshwarlu, Advocate for the Petitioner and of the Public Prosecutor on behalf of Respondent-State, the Court made the following.
ORDER:-
“The petitioner is A2. He seeks for grant of anticipatory bail. He allegedly committed an offence under the provisions of the NDPS Act and also under the provisions of the Andhra Pradesh Excise Act. Three kgs., of diazepam and two kgs., of chloral hydrate were recovered from the possession of A1 by the investigating agency. A1 confessed about the complicity of A2 in the commission of offence.
The learned counsel for the petitioner submitted that no contraband was seized from the possession of A2. Added to it, charge sheet had already been filed. I therefore consider it appropriate to enlarge the petitioner on anticipatory bail.
Consequently, this Petition is allowed. The petitioner shall surrender before the Judicial Magistrate of First Class, Thandur, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Thandur, shall enlarge the petitioner on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties in a like sum to his satisfaction.”
