K.B.Chandrashekarswamy, Advocate) …Petitioner …Respondent This Civil Petition is filed under Section 24 of CPC, praying to withdraw the M.C.No.1829/2018 from the file of the II Additional Principal Judge, Family Court, Bengaluru and transfer the same to the court at Senior Civil Judge at Chitradurga, by allowing this petition in the interest of justice and equity.
This Civil Petition coming on for admisssion, this day, the Court made the following :
ORDER The petitioner is the wife of the respondent. She has sought transfer of M.C.1829/2018 from the court of Prl. Judge, Family Court, Bengaluru to the court of Sr. Civil Court, Chitradurga. It is stated that the petitioner is residing at Chitradurga and she finds it difficult to travel from Chitradurga to Bengaluru on every date of hearing in connection with the said M.C. petition. It is also stated that she has a child and therefore she cannot come to Bengaluru leaving the said child at Chitradurga.
2. Heard the petitioner’s counsel and the respondent’s counsel.
3. It is not disputed that the petitioner is now a resident of Chitradurga. Having regard to the reasons given in the petition, I am of the opinion that this petition can be allowed. Therefore petition stands allowed. M.C.No.1829/2018 pending on the file of 2nd Addl. Prl. Judge, Family Court, Bengaluru is withdrawn from the said court and transferred to the Court of Sr. Civil Judge, Chitradurga. The records in M.C.1829/2018 shall be transmitted to Chitradurga court.
