The present Misc. Civil Application has been filed for review under Order 41 of the Civil Procedure Code of the judgment passed by this Court in aforesaid First Appeal No.2609 of 2011 dated 11.01.2012 on the grounds stated in the application.
Heard learned counsel, Mr.Chaitanya Joshi with learned counsel, Mr.R.M. Parmar for the applicants.
After arguing for some time, learned counsel, Mr.Joshi on instruction does not press this application. However, he has requested that with a view to approach the Hon'ble Apex Court, some time may be granted and execution proceeding being Execution Petition No.106 of 2011 pending before the Court of the 3rd Additional Senior Civil Judge, Ahmedabad (Rural), Mirzapur may be stayed for four weeks.
As the aforesaid Misc. Civil Application has not been pressed and learned counsel, Mr.Joshi has stated that the appellants desire to approach the Hon'ble Apex Court, in the interest of justice the request for stay of the execution proceedings is granted. Therefore, execution proceeding being Execution Petition No.106 of 2011 pending before the Court of the 3rd Additional Senior Civil Judge, Ahmedabad (Rural), Mirzapur shall remain stayed till 26th March, 2012.
With the above directions, the present Misc. Application stands disposed of accordingly.
