Heard learned counsel for the petitioners and learned Standing Counsel for the State-respondents.
In both these writ petitions identical controversies are involved. They have, therefore, been heard and are being decided together.
The writ petition arises out of proceedings under Section 67 of the Revenue Code, 2006 drawn against the petitioners for their eviction from separate areas plot No. 276. The evictions were ordered and the orders have been affirmed on dismissal the consequential appeals, preferred by the petitioners.
The contention of counsel for the petitioners is that the proceedings under Section 38 have been instituted for correcting numbers 276 and 246 interchanging them as revenue records wrongly recorded these numbers.
Therefore, the argument of counsel for the petitioners is that in case correction in the revenue records is ordered the petitioners would cease to be unauthorized occupants.
In any case summary proceedings for correction of papers do not determine the title of the parties.
It is however observed that in case, the proceedings for correction of papers are decided as per the claim therein, it shall be open for the revenue authorities to revisit in the orders impugned in the writ petition.
Subject to the above, both these writ petitions stand disposed of.
