Order on Civil Misc. Substitution Application This application has been filed by the applicant with a prayer for substituting the heirs and legal representatives of the applicant namely Amrit Lal who is said to has died on 29.07.2019 reference of which has been made in paragraph No.2 of the affidavit filed in support of the aforesaid application. Learned counsel for the applicant further prays that the word "deceased" be inserted after the name of applicant Amrit Lal in the contempt application.
Sri K.R. Singh, learned counsel for the opposite party has no objection on the same.
In the circumstances and for the reasons given in the accompanying affidavit, the substitution application is allowed.
Let the heirs and legal representatives of deceased- applicant namely Amrit Lal mentioned in paragraph No.2 of the affidavit of substitution application be substituted as Smt. Kalawati Devi (Wife) and sons namely Sri Niwas Kumar Gupta and Vishal Kumar Gupta as applicant Nos.1/1, 1/2 and 1/3 respectively in the contempt application and insert the word "deceased" after the name of applicant Amrit Lal.
Learned counsel for the applicant is directed to made necessary amendment in the array of the parties during the course of the day.
Order on the Contempt Application The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the orders dated 08.09.2017 passed in Writ Petition No.59180 of 2005 (Amrit Lal Vs. State of U.P. and others).
Today when the matter was taken up, Sri K.R. Singh, learned Additional Chief Standing Counsel placed instructions received from the office of the opposite party, the same is taken on record and a copy of the same has also been provided to the counsel for the applicant. It is argued that in compliance of the order of this court, the claim of the applicant has been decided by the opposite party by passing order dated 27.07.2018. It is argued by Sri. K.R. Singh, learned Additional Chief Standing Counsel that no further cause of action would further survived and prays for dismissal of the present contempt application.
Heard learned counsel for the parties.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
