The petitioner was allotted a house no. FK-1/54-4C on 19.12.2011 under Manyawar Kashi Ram Shahari Garib Avas Yojana but it is stated that he has not been given possession of the house till date. It is stated that in the meantime, one Ms. Minakshi Mathur had filed a Public Interest Litigation No. 11393 of 2012 alleging that the houses under the said scheme had been allotted to ineligible persons. That Public Interest Litigation was disposed of by the High Court by order dated 29.2.2012 with a direction to the District Magistrate to examine the matter. According to the petitioner, he was also issued a show cause notice on 26.8.2013, annexure-4 to the writ petition wherein it was stated that he did not belong to Uttar Pradesh but to District Gurdaspur, State of Punjab and therefore, he was not eligible for allotment of the house in question to which the petitioner is stated to have filed his reply on 30.8.2013, annexure-5 to the writ petition, but till date no order has been passed.
Learned Standing Counsel is granted three days time to obtain instructions in the matter as to why the respondents are not taking prompt action in the matter and why the petitioner's matter has been kept hanging up for six years after issuance of show cause notice and the petitioner's reply which was filed on 30.8.2013.
