Hon'ble Rajeev Singh,J.
Learned A.G.A. has raised preliminary objection that against the order under Section 72 (2) of the U.P. Excise Act, 1910, passed by District Magistrate Etah and thereafter appeal preferred under Section 72 (7) of the aforesaid Act, therefore, the application under Section 482 Cr.P.C. is not maintainable. The applicant has remedy under Article 227 of the Constitution of India.
Learned counsel for the applicant does not want to press the application with a liberty to file a fresh under the appropriate provisions.
The prayer made is allowed.
The application is dismissed as not pressed with the liberty, as prayed for.
Office is directed to return the certified copies of the order forthwith, after taking photostat of the same.
