On account of alleged unauthorised absence of 789 days charge-sheet is issued to petitioner on 16.7.2020. It appears that a preliminary inquiry was also got conducted in the matter and a report was submitted in May, 2020. This petition has now been filed challenging the preliminary inquiry report as also the charge-sheet issued to petitioner.
There is absolutely no justification for this Court to interfere with the charge-sheet inasmuch as no reasons have been disclosed for the challenge and the defence of petitioner against the charges levelled are not required to be examined, at this stage, by this Court, at the first instance. Various judgments have been referred in this petition but its applicability has not been substantiated. No interference is, therefore, warranted by this Court with the charge-sheet issued to petitioner.
Writ petition is accordingly dismissed.
It is, however, provided that in the event petitioner submits his reply to the charge-sheet within a period of two weeks' from today, the authorities shall ensure that disciplinary proceedings are concluded within a further period of four months.
