By means of the present writ petition the petitioner seeks a direction upon the respondents to issue a duplicate Marks Sheet of TET-2011 and permit him to participate in the counselling.
It is contended by the petitioner that he appeared in U.P.T.E.T. Examination 2011 and was declared passed therein. The respondent no. 2 has issued a marksheet-cum-certificate but in the certificate petitioner's name and his father's name have been misprinted. The petitioner approached to the office of respondent no. 2, from where he was informed that the original papers have been kept in sealed cover in Criminal Case Number No. 675 of 2011 under section 420/120 B and 7/13 of Prevention of Corruption Act, 1988, police station Akbarpur, district Kanpur Dehat.
Learned Counsel for the petitioner has also invited the attention of this Court to the order passed by this Court of Lucknow Bench, Lucknow in Misc. Single No. 5779 of 2014; Anjali Pandey Vs. State of UP, wherein the petitioner in the said case has been permitted to participate in the counselling on the basis of certificate generated from internet.
Accordingly, the respondents are directed to permit the petitioner to participate in the counselling on the basis of statement of marks downloaded from the website of Madhdyamik Shiksha Parishad, U.P. Allahabad. In the event, the petitioner submits a duly attested statement of the marks which he has downloaded, he shall be considered to participate in the counselling provisionally and his result shall abide by the final order in the present writ petition.
Learned Standing Counsel may file counter affidavit within six weeks.
Rejoinder affidavit, if any, may be filed within a week thereafter.
List after expiry of the aforesaid period.
