Heard learned counsel for the petitioner and Sri V.C. Dixit, counsel appearing on behalf of respondent no. 5.
Supplementary affidavit filed today is taken on record.
The contention of counsel for the petitioner is that the father of the petitioner Rashid Ahmad was an employee working with the respondent no. 5 and died on 14.9.1998. It is claimed that the mother of the petitioner has also expired and the petitioner is the legal heir entitled to receive family pension being unmarried daughter of the diseased employee. The petitioner has filed an application for grant of family pension which has been forwarded before the concerned authority, however, no decision has been taken thereupon.
Considering the fact that the claim of the petitioner is pending consideration before the respondent no. 3, the present writ petition is disposed off with liberty to the petitioner to file an application before the respondent no. 3 alongwith copy of this order and the respondent no. 3 shall pass a reasoned order on the claim of the petitioner, as expeditiously as possible, preferably within a period of three months from the date of filing of the copy of the order.
The writ petition stands disposed off in terms of the said direction.
