This petition has been filed for a direction upon the Principal of the Netaji Inter College, Barki, Varanasi to allow the petitioner to join on the post of Paricharak which was reserved for Schedule caste candidate.
Except to state that petitioner has been appointed and is working, there is no material to show that his appointed has ever been approved or he was getting the salary from the State. It is not disclosed as to why the petitioner is not being permitted to work in the Institution. Although an order passed in Special Appeal No. 758 of 2010 filed by one Ashok Kumar Singh has been annexed but it is not clear as to what impact this order has for the present petitioner. In the absence of the requisite details with regard to appointment or grant of approval no mandamus can be issued for the petitioner to be allowed to work.
However, it shall be open for the petitioner to approach the Inspector ie. respondent no.3 in respect of his grievance who shall examine his claim in accordance with law.
Subject to the observation made above, this petition is consigned to records.
