Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State- respondents.
The claim of the petitioner is that the petitioner's land has been utilized for broadening of State Highways and the compensation that has been determined for utilization of land of the petitioner is treating the land to be agricultural whereas the petitioner claims that the land is non agricultural.
Upon query being made as to whether any declaration has been made under 143 of the U.P.Zamindari Abolition and Land Reforms Act, no answer is forthcoming. On the contrary, learned Standing Counsel pointed out that the petitioner himself has made an application for declaration of land as non-agricultural.
That being the case, no relief can be granted to the petitioner in this writ petition.
The writ petition is misconceived and it is, accordingly dismissed.
