1. Rule.

Mr Pandya waives service of notice of Rule.

2. The present application has been preferred by the applicant -convict for temporary bail on the ground that he wants to construct a house.

3. It appears from the jail report that the convict was released on furlough from 9th November 2011 to 22nd November 2011, and therefore, during the said period he could complete his work.

4. Under the circumstances, discretion does not deserve to be exercised. The application is rejected. Rule is discharged.
