An identical issue was considered by the learned Judge in Writ- A No.7827 of 2019 (Manisha Ahirwar Vs. Uttar Pradesh Basic Education Board And Another) and the writ petition disposed of in the following terms:-
"The petitioner seeks transfer from District Amethi to Jhansi on the ground that her children are studying in Jhansi.
As per, the transfer policy framed by the Basic Education Board, the applications are received online. Quality point marks are awarded to the candidates pursuant to the Government Order dated 13.6.2017 and the list of transferees is prepared on the basis of quality point marks awarded to each applicant.
It appears that the petitioner though applied for Inter District transfer in the academic session 2017-2018, but she did not attain the requisite quality point marks and her request for Inter District transfer is, thus, being turned down. There is nothing on record to assert any illegality in the exercise undertaken by the U.P. Basic Education Board, in the matter of Inter-District transfer nor there is any challenge in this regard.
No exception, therefore, can be taken. Moreover, this writ petition seeking mandamus cannot be entertained at this stage, as the current academic session had commenced from 1.4.2019. It is open for the petitioner to apply afresh in the next academic session 2020-2021 as per the transfer policy framed by the State.
With the aforesaid observations, the writ petition is disposed of."
Following that decision, this petition shall also stand disposed of on similar terms.
