Heard learned counsel for the petitioner. Learned Standing Counsel has accepted notice on behalf of respondents no.1 to 4.
The petitioner has preferred the present writ petition inter-alia with the prayer to consider the candidature of petitioner for the vacant post in terms of Rule 14 of U.P. Secondary Education Service Selection Rules, 1998.
It is argued by learned counsel for the petitioner that petitioner is entitled for her promotion on the post of Assistant Teacher in L. T. Grade in terms of the aforesaid rules but though a considerable time has already lapsed, his claim for promotion has not been taken into consideration. It is further argued that in this regard a representation was made by the petitioner before the various authorities from time to time but till date no decision has been taken on the same.
It is argued by learned Standing Counsel that case for promotion of the petitioner will be considered by the promotional committee constituted under Section 12 of the Act No.5 of 1982 by the respondent no.2 expeditiously.
Heard learned counsel for the parties.
With the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, the petitioner is permitted to make a fresh representation ventilating all his grievances before the respondent no.2 along-with certified copy of this order within a period of two weeks from today. If such a representation is made, the respondent no.2 is directed to pass appropriate order strictly in accordance with law within a further period of three months.
With the aforesaid observations, present writ petition is disposed of finally.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
