Heard learned counsel for the petitioners and perused the record.
By means of this writ petition under Article 227 of the Constitution, the petitioners have prayed for following relief as substantial one :-
"(ii).Issued an order or direction to direct the respondent no. 1/Learned Civil Judge (S.D). Chitrakoot to decide the application 6C of the temporary injunction application under Order 39 Rule 1 CPC in the suit of the petitioner which was filed by the petitioner for the permanent injunction against the respondent no. 2 to 16 for the described property, the Original Suit No. 33 of 2021 Amoghshakti and Another v. Ram Sakhi and Other pending in the court of Learned Civil Judge (S.D.) Chitrakoot expeditiously, if possible within stipulated period, otherwise the petitioner will suffer irreparable loss and injury.
Considering the overall facts and circumstances of the case, the petition is disposed of with a direction to the court concerned to consider and decide the decide application 6C of the temporary injunction application under Order 39 Rule 1 CPC strictly in accordance with law and after recording satisfaction regarding service of summons and after giving full opportunity of hearing to the appearing parties, as expeditiously as possible preferably within a period of two months from the date of production of copy of this order.
