This anticipatory bail application u/s 438 Cr.P.C. has been moved seeking the bail of applicant namely Jakiba, in the event of her arrest in Case Crime No.228 of 2019, u/s 498A, 323, 504, 506, 326A I.P.C. and Section 3/4 D.P. Act, 1961, Police Station-Barhapur, District-Bijnor.
Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.
In this case the applicant along with the co-accused are facing serious allegations who are said to have meted out extreme cruelty towards the victim after her marriage. It appears that at some point of time a serious attack upon the victim was made in which acid was thrown upon her. The medical examination available before the court indicates multiple injuries on her person including blisters. The allegations are there to indicate that the ill-treatment owes its origin to the rapacious nature of the accused who pressed for further dowry and as a result of its non-fulfilment all sort of ill-treatment was heaped upon the victim who was tortured mentally and physically both eventually resulting into such kind of macabre incident as has already been described in the F.I.R.
After considering the submissions advanced on behalf of rival sides, the nature and gravity of the accusation and the material in support of the same, I find no good ground for grant of anticipatory bail to the applicant.
Accordingly, the anticipatory bail application is rejected.
It is clarified that the observations, if any, made in this order are strictly confined to the disposal of the bail application and must not be construed to have any reflection on the ultimate merits of the case.
