This Original Petition (FC) is filed under Article 227 of the Constitution of India for the following reliefs:-
“(i) Issue an order or direction, directing the Family Court, Ernakulam to dispose of Ext.P2 (reconsideration petition) before ordering delivery of the property in E.P.No.6/2008 in O.P.No.1136/2006 including the delivery of the residential building of the petitioner.
(ii) Issue an order of prohibition prohibiting the Family Court, Ernakulam in evicting the petitioner and 3rd respondent from their residential building in Sy.No.359/5 of Elamkulam Village, till the disposal of this Original Petition.
(iii) stay all further proceedings in E.P.No.6/2008 in O.P.No.1136/06 on the file of the Family Court, Ernakulam including the delivery of the property and residential building till the disposal of E.A.No.5/2014; and
(iv) Such other reliefs this Hon'ble Court deems fit and proper to grant in the facts and circumstances of the case.”
2. There is no representation for the petitioner when the matter was taken up. We have anxiously gone through the records and the O.P(FC) No. 189 of 2014 :-2-:
report submitted by the Registrar (Judicial) dated 7.4.2014. It is stated that as directed by this Court, he contacted the Presiding Officer, Family Court, Ernakulam. He was informed by the Presiding Officer that orders on E.A.No.53/2014 in E.P.No.6/2008 in O.P.No.1136/2006 could be passed on 8.4.2014 itself.
In the light of the report and also that there is no representation for the petitioner on the previous posting date as well as today, this O.P.(FC) is dismissed for default.
