JUDGMENT / ORDER

1. Heard learned counsel for the parties.
2. The present contempt petition has been filed for alleged violation/non-compliance of the judgment and order dated 18.10.2008 passed by the writ-Court in Writ Petition No.5680 (S/S) of 2008 filed by the petitioner.
3. Pursuant to issuance of contempt notice, an affidavit of compliance of Mr. Nand Lal Gupta, District Inspector of Schools, Amethi has been tendered today in the Court, which is taken on record.
Paragraph-6 of the said compliance affidavit reads as under:-
"6. That therefore the deponent vide letter dated 17.01.19 sought instructions/directions from the Directorate regarding the payment of salary to the Petitioner. The necessary directions were issued by the Directorate on 22.08.19 in furtherance of which the deponent has, vide letter dated 24.08.19, directed the Manager/Principal of the College to submit the bills relating to the payment of salary of the Petitioner on the basis of his attendance/working in the College. The deponent undertakes that as soon as the bills are forwarded by the Manager/Principal of the College the payment of salary shall be made to the Petitioner. Copies of the letters dated 17.01.19, 22.08.19 and 24.08.19 are enclosed as Annexure No.A-2, A-3 & A-4 with this affidavit.
4. In view of the undertaking that as soon as the bills are forwarded by the Manager/Principal of the College, the payment of salary would be made to the petitioner, in this regard the District Inspector of Schools has written letters to the Principal/Manager for sending the bills.
5. The District Inspector of Schools is not powerless if the Committee of Management does not send the bills. It is for him to see that the payment of salary is made to the petitioner.
6. In view thereof, the present contempt petition is disposed of finally with a direction to the District Inspector of Schools to ensure the payment of salary to the petitioner and to take effective steps for that purpose. If the payment of salary is not made within two months from the date of production of certified copy of this order, it would be open to him to file a proper application for revival of the contempt petition.
