Heard learned counsel for the petitioners and the learned A.G.A. This writ petition has been filed praying for the following reliefs:
"a) To issue a writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 25.09.2020 lodged by the respondent No.4 against the petitioners in Case Crime No.343/2020, under Section 2/3 U.P. Gangster and Anti Social (Prevention) Act, Police Station Kotwali Dehat, District - Saharanpur (Annexure no.1 to this writ petition).
b) To issue a writ, order or direction in the nature of mandamus commanding respondents/authorities not to arrest/prosecut the petitioners in pursuance of the first information report dated 25.09.2020 lodged by the opposite party No-4 against the applicant which is registered as case crime no.343/2020 under Section 2/3 U.P. Gangster and Anti Social (Prevention) Act, Police Station Kotwali Dehat, District Saharanpur."
After the arguments were heard at some length, learned counsel for the petitioner states that the petitioner wants to withdraw the writ petition and therefore, it may be dismissed as withdrawn with liberty to apply for bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioner.
In view of the aforesaid, the writ petition is dismissed as withdrawn with liberty to the petitioner to apply for bail.
It is made clear that we have not expressed any opinion on merits of the case of the petitioner.
