Heard Sri Prem Chandra Dwivedi, learned counsel for the applicants and Sri Vimal Kumar Pandey, learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed seeking the quashing of entire proceeding including the charge sheet dated 25.3.2019 as well as congnizance order dated 7.5.2019 in case no. 217 of 2019 arising out of case crime no.144 of 2018, under Sections 498-A, 323, 406 and 506 IPC and 3/4 Dowry Prohibition Act, P.S. Mahila Thana, District Agra, pending in the Court of Additional Chief Judicial Magistrate 5th, Agra.
Learned counsel for the applicants contends that this is a family dispute, so there is likelihood of the parties entering into compromise in this case, hence this matter may be referred to the mediation centre, Allahabad High Court for mediation between the parties to explore the possibilities of compromise.
Let notice be issued to O.P. No. 2 (Smt. Sonam) by registered post as well as ordinary mode directing her to appear before the Mediation Centre of Allahabad High Court on 31.7.2019 for mediation between the parties.
Steps be taken within 15 days.
For meeting out her expenses, applicant No. 1 is directed to deposit an amount of Rs.20,000/- within 15 days from today at Mediation Centre out of which the amount of Rs.15,000/- shall be paid to O.P. No.2 when she appears before the Mediation Centre on the date fixed and the remaining amount shall go to the Mediation Centre, Allahabad High Court.
It is made clear that notice shall be issued to O.P. No.2 only after deposition of aforesaid amount by applicant No.1 at Mediation Centre.
The Mediation Centre shall, thereafter, submit its report within two months.
List thereafter on 10.10.2019, till then no coercive steps shall be taken by the court below against the accused applicants.
In case, the amount which is directed above, is not deposited, interim relief shall stand vacated.
