Learned Advocate Mr. Pratik Jasani for the applicant has produced on record the application, jointly filed by the applicant and the respondent No.2 i.e. husband and wife, before the Family Court, Rajkot, stating that due to change of circumstances they have filed consent divorce petition and prayed to cancel the order of maintenance under Section 127 of the Code of Criminal Procedure. The respondent No.2 has also filed an affidavit to that effect. The said application filed by the applicant and the respondent No.2 and the Affidavit filed by the respondent No.2 and the order dated 20.4.2012, passed by the learned Judge, Family Court, Rajkot, be taken on the record.
In view of above, learned Advocate for the applicant seeks permission to withdraw this application. Permission is granted. This Application is disposed of. Notice is discharged.
