Upon hearing learned advocate for the applicant, the discrepancies pointed out in the Note for Speaking to Minutes deserve to be corrected. It is, therefore, directed that in the order dated 19.12.2012, passed in Misc. Civil Application No. 3074 of 2012, in para-7, the line Proceedings of H.M.P. No. 17 of 2012, filed by the respondent herein in the Family Court at Rajkot is ordered to be transferred to the District Court at Dhrangadhra. Learned Principal Judge, Family Court, Rajkot is directed to send R&P of H.M.P. No. 17 of 2012 to the District Court at Dhrangadhra, forthwith. Rule is made absolute be read as Proceedings of H.M.P.No. 17 of 2012, filed by the respondent herein in the Family Court at Rajkot is ordered to be transferred to the Principal District Judge at Surendranagar and thereafter, in turn, the said proceedings be transferred to the Civil Court at Dhangdhra. Learned Principal Judge, Family Court, Rajkot is directed to send R&P of H.M.P. No. 17 of 2012 to the District Court at Surendranagar, forthwith. Rule is made absolute.
The order dated 19.12.2012 is modified accordingly. The rest of the order shall remain the same.
The Speaking to Minutes is disposed of accordingly.
