Heard Mr.C.B.Upadhyaya, learned advocate for the petitioners, Mr.Pranav S.Dave, learned Assistant Government Pleader for respondent No.1 and Mr.Suresh M.Shah, learned advocate for respondents Nos.2 and 3.
It is submitted by Mr.Upadhyaya that the same order, as that challenged in the present petition, has been challenged by another person in Special Civil Application No.13553 of 2011, in which the Court has directed status-quo, as it existed on the date of passing of the order dated 19.09.2011, to be maintained. It is submitted that since no order of status-quo was passed in the present petition, which is a cognate matter, respondents Nos.2 and 3 are raising objections in proceedings before the Collector. Therefore, a similar order of status-quo be passed in the case of the petitioners, as well.
Mr.Suresh M.Shah, learned advocate for respondents Nos.2 and 3, submits that an order of status-quo may not be passed from the back date, but from the actual date of passing of the order.
Having heard the learned counsel for the respective parties, the following order is passed:
Status-quo, as it exists today qua the petitioners, shall be maintained till the next date of hearing.
