By way of present application, the applicant has prayed to modify the condition No.7(e) imposed upon the applicant by this Court vide order dated 28th September, 2011 passed in Criminal Miscellaneous Application No.13287 of 2011 and permit the applicants to enter into limits of State of Maharashtra. The condition No.7(e) reads as under:
"7(e) not leave the State of Gujarat without the prior permission of the concerned Sessions Judge;"
Heard Mr.Kruti Shah, learned counsel for the applicant and Mr.H.L. Jani, learned Additional Public Prosecutor for the respondent-State.
In view of averments made in the application and submissions advanced by learned counsel for the applicant, present application is hereby partly allowed. Condition No.7(e) of the order dated 28th September, 2011 passed in Criminal Miscellaneous No.13287 of 2011 is hereby deleted. Rule is made absolute to the aforesaid extent.
Direct Service is permitted.
