(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Heard learned counsel for the applicant.
Present application is for impleading the opponent No.4 as party respondent in the main Letters Patent Appeal.
Considering the facts and circumstances of the case and the averments made in the civil application, present civil application is allowed in terms of Para.5(A). The applicant is permitted to implead opponent No.4 - Dakshin Gujarat Vij Co. Ltd. as party respondent in the main Letters Patent Appeal. Cause title of main Letters Patent Appeal be amended accordingly.
The main appeal is adjourned for four weeks in order to enable the learned counsel for the applicant - appellant to carry out the amendment.
Meanwhile, learned counsel, Mr.Sinha to take appropriate instructions as to whether he is appearing on behalf of newly impleaded respondent No.4 or not.
