On 11.6.1966, the Consolidation Officer held the petitioners to be a Bhumidhar of the land in question. Thereafter, the matter was raked up under Section 48 (3) and when orders were passed against the petitioners, the petitioners filed a writ petition in this Court and the order which was passed under Section 48(3) was stayed by the High Court on 21.11.2019. In the meantime, on 28.9.1982, a Suit filed by the petitioners under Section229B was also decreed in favour of the petitioners.
Grievance of the petitioners is that once when the petitioners were held to be a Bhumidhar, they could not be evicted as Asami.
Matter requires consideration.
Issue notice to the respondent no. 5. Steps be taken within a week.
The respondents no. 1,2 and 3 are represented by the learned Standing Counsel and the respondent no. 4 is represented by Sri S.K. Singh.
Respondents may file their counter affidavits within three weeks. The petitioners shall have two weeks' time thereafter for filing rejoinder affidavit.
List on the date indicated in the notice.
Till the next of listing, status quo as of today shall be maintained.
