The present 482, Cr.P.C. application has been filed by the applicant to quash the order dated 28.8.2018 passed by the Principal Judge, Family Court, Etah in Case No.81 of 2016 (Smt. Rashi Verma Vs. Amit Singh Verma) under Section 125, Cr.P.C., P.S. Kotwali Nagar, District Etah.
It has been submitted that the finding recorded by the Principal Judge, Family Court, Etah that the opposite party No.2 is residing at Eath is not justified since the address of Etah is of the counsel, Shri B.K. Verma, who has filed the application under Section 125, Cr.P.C. on behalf of O.P. No.2 and her children at Etah. It is submitted that in proceedings under Section 9 of the Hindu Marriage Act filed by the applicant before the Family Court, Agra, she has mentioned her address of Kamla Nagar, Agra. She is residing at Agra, but the proceedings under Section 125, Cr.P.C. has been instituted at Etah only for the purpose of harassment of the applicant. No useful purpose would be served by keeping this application pending.
Accordingly, order dated 28.8.2018 passed by the Principal Judge, Family Court, Etah is set aside.
It is open for the court below to pass fresh order in accordance with law.
