A complaint letter dated 30th September, 2018 written by Sri Amit Pratap Singh son of Sri Parashuram Singh addressed to Hon'ble the Chief Justice has been placed before us under order, dated 16.05.2019, of Hon'ble Administrative Judge, Deoria.
A perusal of the complaint letter, dated 30th September, 2018, would reveal that in respect of loss of machinery, etc. belonging to the State, a Criminal Case No.1336 of 2013 was registered at the police station concerned for offences punishable under Sections 407, 414, 34 IPC in which, after investigation, the police submitted a charge sheet pursuant to which Case No.4092 of 2017 (Old No.3390 of 2013) is pending in the court of Chief Judicial Magistrate, Deoria.
The complainant has stated that the proceeding of the case is going at a lethargic pace, therefore, the matter should be examined by this Court.
We are of the view that drawing a parallel proceeding, while the matter is already being examined at the level of the Magistrate, would serve no public interest. Rather, it would interfere in proper administration of justice.
In view of the above, the petition as well as complaint is consigned to the record.
