Heard learned counsel for the applicant, learned AGA for the State and perused the record.
This application under Section 482 CrPC has been filed with a prayer to direct the learned Judicial Magistrate, Kasiya, Kushinagar to decide the Misc. Application No. 1943 of 2020 (Amit Pratap Singh Vs. State of U.P.), under Section 173(8) CrPC, within stipulated period.
Learned counsel for the applicant has submitted that he has filed Misc. Application No.1943 of 2020 (Amit Pratap Singh Vs. State of U.P.), under Section 173(8) CrPC for further investigation, however, the said application is pending since 29.07.2020 and the proceeding has been lingering-on, on one pretext or the other.
In view of the above, learned court below is directed to make all endeavours to decide the aforesaid application as expeditiously as possible, preferably within a period of two months from the date of filing of certified copy of this order without giving any unnecessary adjournments to either parties, if there is no other legal impediment in deciding the aforesaid application.
With the aforesaid direction, this application under Section 482 CrPC is finally disposed of.
