Heard Sri Sankalp Narain, learned counsel for the petitioner and Sri Rahul Malviya, learned Standing Counsel for the State respondents.
By means of present petition, the petitioner has challenged the order passed by the Tehsildar dated 19.11.2010 whereby caste certificate of the petitioner has been cancelled.
Learned counsel for the petitioner today has filed supplementary affidavit annexing therewith the order of the District Scrutiny Committee dated 26.7.2014 which has virtually maintained the order of the Tehsildar and against the said order, the petitioner has approached the Lucknow Bench of this Court which relegated the petitioner to the remedy of appeal and in view of that an appeal is now pending before the Commissioner.
In view of fact that the order of Tehsildar merged with order of District Scrutiny Committee is pending before the Commissioner, the argument that Tehsildar did not possess necessary authority to cancel the cast certificate is no more of any significance as District Scrutiny Committee has already taken a decision.
In such view of the matter now no question for setting aside the order of Tehsildar arises and for all practical purposes, the writ petition has got rendered infrcutuous.
In view of above, the writ petition is dismissed as infructuous.
