Heard Sri M.P.S. Chauhan, learned counsel for the petitioner and Sri Sanjay Kumar Srivastava, learned Standing Counsel for the State-respondents.
By means of this writ petition, the petitioner has prayed for a direction in the nature of mandamus directing the respondents not to harass the petitioner and his entire family in any manner.
Learned counsel for the petitioner states that though the petitioner had previous antecedent of criminal case, which is of the year 2007 in which he has already acquitted. He further states that the respondent nos.3 and 4, who are police officials are continuously visiting the house of the petitioner and making illegal demand from him and also extending threats of dire consequences.
It is to be noted that in case there is any threat upon the petitioner, it is always open to the petitioner to take recourse as available to him under the law to protect his life and liberty.
In writ proceeding, no such order can be passed unless there is violation of any fundamental right of the petitioner.
The writ petition is misconceived and is, accordingly, dismissed.
