1. Heard Sri Dharmendra Singhal, learned counsel for applicant and learned A.G.A. for State of U.P.
2. Applicant has invoked jurisdiction of this Court under Section 482 of Code of Criminal Procedure, 1973 (hereinafter referred to as "Cr.P.C.") with a prayer for quashing the complaint and consequential proceedings in Complaint Case No. 496 of 2003, under Section 138 of Negotiable Instrument Act, Police Station Banna Devi, District Aligarh, pending in the Court of Chief Judicial Magistrate, Aligarh.
3. Initially, learned counsel for applicant sought to argue that complaint has not been filed by proper person but after some argument, he said that he may be permitted to raise his defence before Court below.
4. In view of above, application is rejected with aforesaid liberty.
